The lawsuit, filed in Thomas County District Court, alleges that Pfizer made multiple misleading statements about the vaccine's safety, including claims that it was "safe and effective" despite knowing of serious adverse events associated with its use.
According to the complaint, Pfizer knew that its COVID-19 vaccine was connected to serious adverse events, including myocarditis and pericarditis, failed pregnancies, and deaths. The lawsuit claims that Pfizer concealed these risks from the public, even though it maintained its own database of adverse events.
"Pfizer said its COVID-19 vaccine was safe even though it knew its COVID-19 vaccine was connected to serious adverse events," the lawsuit states. "The company's representations about the vaccine's safety were false and misleading."
The lawsuit also alleges that Pfizer coordinated with social media officials to censor speech critical of COVID-19 vaccines and declined to participate in the federal government's vaccine development program, Operation Warp Speed, to avoid government oversight.
In response to the lawsuit, Pfizer issued a statement saying, "The representations made by Pfizer about its COVID-19 vaccine have been accurate and science-based. The company believes that the state's case has no merit and will respond to the suit in due course."
The lawsuit seeks damages for Pfizer's violations of the Kansas Consumer Protection Act and asks the court to order Pfizer to pay civil penalties for alleged violations of previous consent orders with the state.
This is not the first time Pfizer has faced legal action over its COVID-19 vaccine. In 2023, Texas Attorney General Ken Paxton sued Pfizer for "unlawfully misrepresenting the effectiveness of the company's COVID-19 vaccine and attempting to censor public discussion of the product." That suit was also based on the state's Consumer Protection Act.
