Protection from Political Retribution Cited as Reason for Unprecedented Action

Washington, D.C. - January 20, 2025

In a dramatic and unprecedented use of presidential power, President Joe Biden issued preemptive pardons Monday morning to several key figures including Dr. Anthony Fauci, General Mark Milley, and members of the House Select Committee that investigated the January 6, 2021, Capitol attack. The move also extended to five members of Biden's own family, signaling a clear intent to shield them from potential legal battles under the incoming Trump administration.

As the clock ticked down to Donald Trump's second inauguration, Biden's actions were framed as a safeguard against what he described as "unjustified and politically motivated prosecutions." The pardons come amidst a backdrop of threats and promises of revenge from Trump and his allies, particularly targeting those who played roles in scrutinizing his actions during and after his presidency.

Dr. Anthony Fauci, who became a polarizing figure for his handling of the COVID-19 response, expressed gratitude for the pardon, emphasizing that while he acknowledges no wrongdoing, the threat of investigation presents significant distress. "There is absolutely no basis for these threats," Fauci stated, highlighting years of public service under multiple administrations.

General Mark Milley, who faced accusations and vitriol from Trump for his role in military affairs, including a contentious call to reassure China of U.S. stability post-January 6, similarly welcomed the pardon. "I do not wish to spend whatever remaining time the Lord grants me fighting those who unjustly might seek retribution for perceived slights," Milley remarked, grateful for the legal shield.

The Jan. 6 Committee members, who had been at the forefront of investigating the Capitol riot and Trump's involvement, were also included in the pardon. This group, led by Rep. Bennie Thompson and former Rep. Liz Cheney, had faced intense criticism and threats from Trump's supporters. The committee's findings, which included recommendations against Trump holding office, had significantly escalated political tensions.

The decision to pardon family members was perhaps the most surprising, with Biden citing "unrelenting attacks and threats" as motivation. This included his brothers, sister-in-law, and others close to him, who have been subjects of various Republican-led inquiries into the Biden family's business dealings, though no criminal wrongdoing has been substantiated.

The response to these pardons has been sharply divided. Critics, notably from Trump's camp, argue that the pardons suggest an admission of guilt or are a misuse of presidential clemency. On the other hand, supporters see it as a necessary step to protect democracy from what could be perceived as political vendettas.

This action by Biden, one of his final as president, sets a unique precedent for how outgoing administrations might protect not just themselves but allies and family from the political machinations of their successors. As Trump prepares to take office again, these pardons could significantly alter the landscape of investigations and legal pursuits in the coming years.
